There are over 4,000 offenses that carry criminal penalties in the United States Code such as tax evasion, terrorism and drug trafficking. Additionaly, any crime that is committed on federal property is subject to prosecution in the federal system. Because of the large military installations in the First Circuit federal prosecutions are quite common. Even a simple battery or DUI if committed on federal property can be prosecuted in federal court.

Federal felony offenses are subject to harsh incarceratory periods and probationary sentences are not the norm if you are convicted. The sentencing laws have recently changed. District Court Judges are no longer bound by the federal sentencing guidelines. The guidelines are now considered to be “advisory.” There is though a presumption of reasonableness” if a District Judge chooses to sentence utilizing the guidelines. A District Judge must include the guidelines range in the array of factors warranting consideration. But the Judge may determine that a within-guidelines sentence is "greater than necessary" to serve the objectives of sentencing.
